LICENSED MATERIALS

TeachNovels.com owns and maintains the intellectual property rights of all TeachNovels resources and grants licenses to use these resources as described herein. In making a purchase, you license a resource and agree to use said resource in accordance with the terms of this policy. All retail resources (exclude free and sample resources) can only be used in accordance with a valid license.

Your use of any resource is subject to this licensing policy. When you download a resource (or receive any resource license purchased on your behalf) you agree to comply with the terms of this policy.

License holders may not transfer the usage rights once they have been assigned. Assignees may not disseminate the resource materials to other parties.

In short: TeachNovels.com resources are protected by copyright. Only individuals or organizations who have purchased the appropriate license may use these materials. Licenses are non-transferrable.

 

INDIVIDUAL LICENSES

Most TeachNovels.com resources are used under an Individual License. An Individual License may only be assigned to a specific user (e.g., one teacher) for that person’s lifetime use. Individual Licenses are non-transferable and may not be used by or reallocated to a different person. A teacher who purchases an Individual License may not transfer the license regardless of the circumstances.

The Individual License is intended for one educator, parent, caregiver, or instructor.  The Individual License is not for use by multiple instructors within a school, system, department, or teaching team.

LICENSE ASSIGNMENT

Once a license has been assigned to someone, the license cannot be used by any other person. Additional licenses must be purchased as needed. The purchase may be made on someone else’s behalf with the license assigned to the intended recipient alone. (For example, a lead teacher might use department funds to license a resource for a colleague.) The initial assignment of the license does not represent an illegal transfer. You may not reallocate an Individual License from one assignee to another or share the resource with additional users.

RIGHTS AND LIMITATIONS

As the holder of an Individual License, you may…

    • Use the resource for personal, educational, and instructional use.
    • Print and make copies of downloadable resources as necessary. Copies may be made and provided to your students, classroom aides, and substitute teachers. Copies may also be made for students’ parents, classroom observers, supervisors, or school administrators for review.
    • Make modifications to soft-copy files for your personal use.
    • Deliver resources electronically to your students (and their support professionals, parents, or caregivers) as needed. Such transmissions must not be available to a larger audience through websites, apps, shared folders, etc.

As the holder of an Individual License, you may NOT…

    • You may not use the resource for commercial purposes.
    • You may not make the resource available on any public website, application, or shared drive.
    • You may not transfer the license or materials to other parties (individuals or organizations).
    • You may not make changes to soft-copy files for the purpose of dissemination or commercial use.

In-short: An Individual License means that one person may use the licensed materials year after year. Sharing materials with another instructor is prohibited. It is illegal for the assignee to disseminate licensed materials online.

 

ORGANIZATION LICENSES

Schools, school systems, subject departments, or other instructional entities may desire one or more Organization Licenses depending on the circumstances.

Organizational Licenses must be granted on a case-by-case basis with the use of a purchase order. Please CONTACT TeachNovels.com to inquire about Organization Licenses and to receive a quote. Quotes are based on the number of instructors, the number of learners, the resource(s) being licensed, and the term of use in years (typically 5 years).

NOTE: Depending on the scale of use, it may be advisable to purchase several Individual Licenses. For example, an English Language Arts department of five teachers might choose to assign five Individual Licenses rather than attaining an Organizational License.

RIGHTS AND LIMITATIONS

    • Material use is limited to the grantee institution. The organization may not publish nor disseminate copyrighted materials to any wider audience.
    • The organization does not retain exclusivity regarding the use of licensed resources. Unless expressly noted by an additional agreement, other institutions may license the same materials.
    • At the expiration of the license term, use of the materials in question must cease. The entity can continue use by obtaining a new Organization License.
    • A new instructor to an institution using a valid Organization License is free to make use of the materials.
    • Materials may not be altered for the purpose of external publication or commercial use.
    • Instructors that leave the grantee organization are no longer free to use the licensed materials.
    • Should the organization undergo an institutional change that impacts the scale of use (e.g., the merging of two school systems), a representative must contact TeachNovels.com to discuss possible adjustments to the license.

INSTRUCTORS UNDER AN ORGANIZATION LICENSE

As an instructor within the grantee organization, you may…

    • Use the resource for personal, educational, and instructional use.

ACCESS DISCLAIMER

TeachNovels.com cannot guarantee continued access to download licensed resources.  After the initial transfer of the files (recorded by the system log of the point of sale), it is the responsibility of the purchaser/assignee to save the resources and ensure personal access.  In other words, TeachNovels.com could disappear next year, so save your stuff.

TeachNovels resources often link to media or resources that are available to the public. The location or availability of these resources may change over time.  TeachNovels cannot guarantee access to materials owned by other entities. For example, a free article from a particular publication referenced as part of a lesson could be removed by the source publication. TeachNovels takes no responsibility for ensuring the availability of these images, documents, clips, etc. over time.

 


DOWNLOAD ADVISORY

TeachNovels.com takes great pains to ensure security and reliability when you download resources.  However, bad actors are consistently developing new tricks to deploy online. You are responsible for scanning any downloads for malicious or harmful software. Make sure that your browser and/or operating system has up-to-date precautions in place.

 


INSTRUCTOR RESPONSIBILITY

TeachNovels.com accepts no responsibility for the pedagogical decisions of the instructor. Some of the materials, topics, or activities offered in TeachNovels resources may be inappropriate in certain contexts or for some learners.  The responsibility for all instructional decisions and pedagogical approaches lies solely with the instructor. TeachNovels provides suggestions and options from which the instructor must choose responsibly.  The inclusion of a piece of content, activity, example, or practice within a resource is not of itself a rationale for use. Carefully consider each resource before implementation.

REFUND POLICY

Since all resources are delivered electronically and a download cannot be “returned,” all sales are considered final and nonrefundable.

If you feel that a refund may be justified due to exceptional circumstances, contact TeachNovels and explain the situation.

    • Refund requests must be submitted within one month of purchase.
    • Refunds are not remitted based on user dissatisfaction.
    • Refunds are limited to situations where a resource was not used. This may include…
        • No download recorded by the system log
        • Compromised resource file
        • Confusion caused by misleading representation
        • Unforeseeable technical issues
        • Duplicate Purchase (under the same user information)

NOTE: Depending on your method of purchase, refunds may take several business days, a week, or even longer to process. This is due to the workings of the point of sale, credit, and/or banking institutions and not the vender. This delay is not within our control.
